建築物的耗電量約佔全港總耗電量九成,通過提升建築物能源效益將有效地減少溫室氣體的排放。機電工程署自1998年已推出自願參與的 「香港建築物能源效益註冊計劃」 ,旨在推廣《建築物能源效益守則》的應用。為進一步推廣建築物能源效益,當局已制定《建築物能源效益條例》( 下稱《條例》 ) ,並於 2012 年 9 月 21 日 起全面實施 (注意:在上述自願性計劃註冊不會視為已經遵守《條例》)。
《條例》的三大規定
- 新建建築物的發展商或擁有人須確保建築物內的空調、照明、電力、升降機及自動梯等 4 類主要屋宇裝備裝置,符合《屋宇裝備裝置能源效益實務守則》(簡稱《建築物能源效益守則》)的設計標準。
- 建築物的負責人(業主、租客或佔用人等)在進行「主要裝修工程」時,須確保建築物內的 4 類主要屋宇裝備裝置符合《建築物能源效益守則》的設計標準。
- 商業建築物(包括綜合用途建築物的商業部份,例如:住宅樓層下的商場)的擁有人須按照《建築物能源審核實務守則》(簡稱《能源審核守則》),為建築物內的該 4 類有關「中央屋宇裝備裝置」每10年進行一次能源審核 (注意:如能源審核已於 2012 年 9 月 21 日前預早進行,請 按此處 參閱有關的過渡性安排)。

新版《建築物能源效益守則》和《能源審核守則》(2021年版) 已於 2021 年12月31日出版並上載至網站內「守則及技術指引」一頁。
新版《建築物能源效益守則》2021年版就首階段聲明(新建建築物)和遵行規定表格(主要裝修工程)的六個月和九個月寬限期過後,將分別於2022年7月1日和2022年10月1日全面實施。新版《能源審核守則》2021年版將於九個月寬限期過後,即於2022年10月1日全面實施。有關詳情,請參閱《建築物能源效益條例》第1/2021號技術通告。
- 遵行《建築物能源效益守則》(現時為 2021 年版)的法定要求適用於守則2021年版全面實施當日(2022 年 10 月 1 日)或之後完成的所有主要裝修工程,與工程的展開日期無關。換言之,即使主要裝修工程在 2022 年 10 月 1 日前展開,若於 2022 年 10 月 1 日當日或之後完成,亦須遵行最新的《建築物能源效益守則》 2021 年版。若主要裝修工程的負責人在遵行《建築物能源效益守則》 2018 年版的個別規定時遇上困難,該負責人可按照條例第 20 條,向機電工程署提出理據,申請豁免遵行該規定。豁免申請表格(表格 EE-EX)

About 90% of total electricity consumption in Hong Kong is contributed by buildings. Through enhancement of building energy efficiency, greenhouse gas emissions can be effectively reduced. In October 1998, the Electrical and Mechanical Services Department has launched the voluntary Hong Kong Energy Efficiency Registration Scheme for Buildings to promote the application of Building Energy Code. To further promote building energy efficiency, the Government enacted the Buildings Energy Efficiency Ordinance (the Ordinance) which is to come into full operation from 21 September 2012 onward (Note: Registration under the voluntary Scheme is not regarded as having complied with the Ordinance).
The 3 key requirements of the Ordinance
- The developers or building owners of newly constructed buildings should ensure that the 4 key types of building services installation therein, namely, air-conditioning installation, lighting installation, electrical installation as well as lift and escalator installation, comply with the design standards of the Building Energy Code (BEC).
- The responsible persons (i.e. owners, tenants or occupiers etc.) in buildings should ensure that the 4 key types of building services installation therein comply with the design standards of the BEC when “ major retrofitting works ” are carried out.
- The owners of commercial buildings (including the commercial portions of composite buildings, e.g. shopping malls under residential storeys) should carry out energy audit for the 4 key types of central building services installation therein in accordance with the Energy Audit Code (EAC) every 10 years. (Note: If energy audit has already been carried out in advance before 21 September 2012, please click here for the transitional arrangement).
Soft Reminder :
The new edition of the Code of Practice for Energy Efficiency of Building Services Installation, 2021 Edition (the BEC 2021) and the Code of Practice for Building Energy Audit, 2021 Edition (the EAC 2021) have been published on 31 December 2021. The Codes are now available at “Codes & Technical Guidelines” on this website.
The new edition of BEC 2021 will be fully implemented on 1 July 2022 and 1 October 2022 for Stage One Declaration (new building projects) and Form of Compliance (major retrofitting works) after a grace period of 6-month and 9-month respectively. The new edition of EAC 2021 will be fully implemented on 1 October 2022 for energy audit after a grace period of 9-month. Please refer to the BEEO Technical Circular No. 1/2021 for details.
- The statutory requirement for compliance with the BEC (currently BEC 2021 Edition) applies to all major retrofitting works completed on or after the effective date of the BEC 2021 (i.e. 1 October 2022), irrespective of the commencement date of the works. In other words, even the major retrofitting works are commenced before 1 October 2022, they are required to comply with the BEC 2021 Edition if they are completed on or after 1 October 2022. If the responsible person of the major retrofitting works has difficulties to comply with certain requirements of the BEC 2021 Edition, the responsible person may apply, with justification, to EMSD for exemption from those particular requirements pursuant to section 20 of the Ordinance. the application form for exemption (Form EE-EX)
